Site plans in California

What a California site plan has to show before a city, county or state agency will act on it: acreage against the CEQA infill exemption, the Permit Streamlining Act clocks, AB 98 warehouse setbacks, the HCD permit for parks, and how Los Angeles, San Diego and Sacramento route review.

What changes a site plan in California

State law reaches into a California site plan in five places before any city or county code applies. Each one comes from a statute or an agency rule, and each one moves a number on the concept sheet.

Acreage decides the CEQA path for infill housing. AB 130 created PRC 21080.66, which the City of Saratoga describes as "a complete exemption from CEQA for all aspects of a qualifying housing development project" [6]. The site must be 20 acres or less, or 5 acres for builder's remedy projects, within an incorporated city or urban area [1]. AB 130 and SB 131 were signed June 30, 2025 and took effect immediately [7]; AB 130 is Chapter 22, Statutes of 2025 [8]. Parcelization becomes a CEQA decision, and the acreage row of the site data table is the first test a housing concept meets.

One missed condition no longer means a full environmental review. SB 131 limits CEQA review for a housing project that misses an exemption by a single condition, exempts housing-element rezonings, and adds sensitive-land definitions at PRC 21067.5 [9]. It also requires the Office of Land Use and Climate Innovation to update the infill tiering guidelines by January 1, 2027 [10]. A plan that records each exemption condition on the sheet shows the reviewer where the one gap sits.

A 60-day decision clock on ministerial housing. Under the Permit Streamlining Act, the agency has 30 calendar days to determine completeness in writing [8]. HCD's April 2026 fact sheet puts the decision on a ministerial housing project at 60 days from a complete application [2]. A PRC 21080.66 infill project is decided within 30 days of the conclusion of tribal consultation (Gov. Code 65950(a)(7)) [8]. Ministerial review applies objective standards, so each standard the project meets should be readable on the plan itself.

Warehouse design rules sit in the Government Code. AB 98 (Gov. Code 65098 to 65098.4) was signed September 29, 2024 [3]. San Bernardino County's guide applies it to new or expanded logistics facilities, with extra requirements within 500 or 900 ft of a sensitive receptor [3]. Gov. Code 65098(b) treats 20 percent or more of existing square footage as an expansion [11]. Truck bays, buffers and gates are placed on the drawing before the building is sized.

RV parks answer to HCD as well as to the county. Under the Special Occupancy Parks Act (HSC 18860 et seq.) and 25 CCR Chapter 2.2, HCD's Division of Codes and Standards, or a local agency that has assumed enforcement, issues the permit to construct and the permit to operate [4, 12]. Lot line changes inside a park need written authorization from the local planning agency (HCD Information Bulletin 2005-10, HSC 18872.1) [13]. A park plan carries both the local entitlement and the state permit to construct.

Approval layers: state, county and city

Cities and counties hold zoning and entitlement power, act as CEQA lead agencies, and work inside the state housing preemptions. The state acts through statute and through agencies that issue their own permits.

LayerWho actsWhat it decides for a site plan
StateHCD; the Legislature through the Government Code; the State Water Resources Control BoardPermits to construct and operate parks [4]; AB 98 logistics standards [3]; Permit Streamlining Act clocks [2]; underground storage tank rules, administered with local CUPAs [14]
CountyBoard of supervisors, planning commission, staffUnincorporated land; in San Bernardino County, logistics use is conditionally permitted in commercial and industrial zones [3]
CityCouncil, planning commission, hearing officer, directorLand inside city limits: Project Review by the Director of Planning in Los Angeles [15], five decision processes in San Diego [16], discretionary site plan and design review in Sacramento [17]

State law does not erase the local layer. San Bernardino County states that its full Development Code applies "unless AB 98 contradicts or supersedes the local requirements" [3]. The Attorney General's September 2022 warehouse best practices document cites Fontana's ordinance and the good neighbor policies of Riverside County, the City of Riverside, Moreno Valley and WRCOG [18]. An Inland Empire logistics concept is checked against both sets of rules.

Who prepares and seals what

Unsealed drafts come first in California, sealed sheets last. The preliminary plan fixes the layout and the yield; the client's engineer and architect of record produce the sealed civil and building sets on that base.

The code edition matters once sheets are sealed. Milpitas, for example, applies its architect and engineer exemptions to plans designed to the conventional framing of Chapter 23 of the 2025 California Building Code [24]. The guides on who prepares a site plan and whether you need an architect, and the site plan architect page, set out how the roles divide.

Air quality is a site factor in the Inland Empire. The Attorney General's letter on Riverside County's policy states "the majority of Riverside County is in the worst 10% for exposure to ozone" [29].

Main jurisdictions with code-cited processes

Four jurisdictions have their site plan process documented down to the code section. Local detail for the rest of each region sits on the Los Angeles and Inland Empire, San Diego and Sacramento metro pages.

Los Angeles. Two zoning systems coexist, LAMC Chapter 1 and the new Chapter 1A, and form CP13-2152.A applies to Chapter 1A properties [30]. Under LAMC 16.05 no grading, foundation, building or use of land permit issues for a project over the thresholds without Project Review, and adaptive reuse under 12.22 A.26 is exempt [15]. The City Planning checklist notes that projects qualifying under Mayor Bass's Executive Directive No. 1 are exempt [35]. Development Review Threshold Package 2 (Chapter 1A) adds any building of 500 ft or taller [30, 36].

San Diego. Process Two is a staff decision with no hearing, appealable to the Planning Commission (SDMC 112.0503) [32]. Process Three is decided by a Hearing Officer [32]. The City's development permit manual says Site Development Permits are required "because of their location, size, or some other characteristic," including Environmentally Sensitive Lands [16]. NDPs and SDPs "may not be used to permit any deviations from the use regulations" [37]. The Planned Development Permit (126.0601 et seq.) allows deviations "in exchange for imaginative and innovative design" [16]. Coastal Development Permits in the appealable area run through Process Three for CIP projects (112.0601) [38], and the online Chapter 14, Article 3, Division 3 text is marked 3-2026 [39].

Sacramento. City Code 17.808.100 makes site plan and design review a discretionary permit that an applicant has no automatic right to [17]. Under 17.808.180 the decision rests on findings that design, layout and physical characteristics are consistent with the general plan and design guidelines and compatible, visually and functionally, with the surrounding neighborhood [33]. Section 17.808.160 exempts minor site alterations, compliant ADUs, registered house plans (site plan review only), ministerial housing and urban lot splits [40]. The Planning and Design Commission was formed in 2012 when separate planning and design commissions were repealed [41].

Tier 1 extras include microgrid-ready switchgear and 50 percent EV-ready passenger parking with 10 percent installed chargers [3]. On the ADU side, local standards cannot preclude an ADU of at least 800 sq ft with 4 ft side and rear setbacks [28].

AB 130 also removed the public notice precondition for deemed approval [55]. AB 2097 does not override EV-charging or accessible-space requirements (Gov. Code 65863.2(f), (i)) [25].

Climate and site factors

Flood rules reach RV parks through the federal definition. Under 44 CFR 60.3, an RV in a Special Flood Hazard Area must meet manufactured home elevation and anchoring unless it is on site fewer than 180 consecutive days, or is fully licensed and ready for highway use [56]. Sierra County requires both conditions rather than either one [57]. Hollister allows parks in the floodplain but caps a stay on any one lot at 180 consecutive days [58]. Wildfire zoning reaches cabins through CRC R327 in Very High Fire Hazard Severity Zones [27], and ozone exposure frames logistics review in Riverside County [29].

Proof points

  • Mariposa County Special Occupancy Park. Lodging units and RVs on 3.49 acres, with a CEQA document filed in 2025 (SCH 2025030958) [59]. The filing pairs an HCD SOP permit with a local amendment making SOPs conditional uses [59].
  • SB 9 in Los Angeles. Through November 2022, Los Angeles approved 38 of 211 SB 9 unit applications and 0 of 28 lot split applications [60].
  • Inland Empire growth. The Riverside-San Bernardino-Ontario MSA added almost 40,000 people from 2023 to 2024 [61].
  • Elk Grove storage pause. A two-year moratorium on personal storage entitlements, per trade press and the city's CEQA Notice of Exemption [47].

What the preliminary plan carries in California

The studio's preliminary site plan is the real first draft of a California project, drawn without the engineering layer. It places the buildings, floor plans, internal roads, drive aisles, parking, pads and units, and it counts the yield in a site data table. For a California site the table answers the state questions first: acreage against the 20-acre infill line, the exemption conditions one by one, truck bay and buffer distances where AB 98 applies, parking required against provided near transit, and, for a park, the road widths and lot occupancy HCD will check.

Utility, grading, drainage and stormwater design stay with the client's engineer of record, who seals that work on top of the preliminary plan. Developers take the plan to a pre-application meeting, to a lender and to a general contractor for pricing before the sealed set exists. The guide to preliminary versus final site plans marks the handoff, and the site plan consultant and site plan services pages describe the engagement. Background reading: building RV parks and resorts in California and campgrounds near water in California.

Frequently asked questions

When did AB 130 and SB 131 take effect?

Both were signed June 30, 2025 and took effect immediately. AB 130 is Chapter 22, Statutes of 2025 [7, 8].

What is the maximum site size for the AB 130 CEQA exemption?

20 acres, or 5 acres for builder's remedy projects, within an incorporated city or urban area. The exemption sits at PRC 21080.66 [1, 6].

How long does a California agency have to decide a ministerial housing project?

60 days from a complete application, per HCD's April 2026 Permit Streamlining Act fact sheet. The agency has 30 calendar days to determine completeness in writing [2, 8].

Who permits RV parks in California?

HCD, or a local enforcement agency that has assumed enforcement under the Special Occupancy Parks Act. The park rules sit in 25 CCR Division 1, Chapter 2.2, starting at section 2000 [4, 12].

Does AB 98 apply to my warehouse?

Yes if it is a new logistics use or an expansion of 20 percent or more, primarily served by heavy-duty trucks, and not exempt (food or household goods sold to the public, rail-served, strategic intermodal). The standards apply to new entitlements from January 1, 2026 [3].

When does Los Angeles require Project Review?

At 50,000 gsf of net new nonresidential floor area, or at 50 or more dwelling units or guest rooms (LAMC 16.05) [15].

How close to the property line can a California ADU be?

A local agency may require no more than 4 ft from the side and rear lot lines (Gov. Code 66314(d)(7)), and a conversion within existing space needs no setback [52].

How much water must a new California car wash recycle?

At least 60 percent of its wash and rinse water, for in-bay and conveyor washes built after Jan. 1, 2014 (Water Code 10951) [5].
